By accessing and using WictzAPI ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service govern your use of our AI API Gateway service.

2. Description of Service

WictzAPI is an AI API Gateway service that provides access to various AI models and providers. The Service allows users to:

  • Access multiple AI providers through a unified API
  • Purchase plan credits for API usage
  • Manage API keys and usage quotas
  • Monitor usage statistics and billing

3. Payment and Billing

One-Time Purchase System: Our service operates on a one-time purchase model, not a subscription system. When you purchase a plan:

  • You receive the specified duration of access (e.g., 30 days)
  • Multiple purchases of the same plan will stack the duration (30+30=60 days)
  • Plan access begins immediately upon successful payment
  • No automatic renewals or recurring charges

4. Service Availability and Reliability

IMPORTANT DISCLAIMER: While we strive to provide reliable service, you acknowledge and agree that:

  • The Service may experience downtime, interruptions, or technical issues at any time
  • AI provider APIs may become unavailable without notice
  • We do not guarantee 100% uptime or continuous availability
  • Service performance may vary based on external factors beyond our control

5. Limitation of Liability

WE ACCEPT NO RESPONSIBILITY OR LIABILITY FOR:

  • Service interruptions, downtime, or unavailability
  • Loss of data, API responses, or usage credits
  • Third-party AI provider failures or limitations
  • Any direct, indirect, incidental, or consequential damages
  • Business losses, revenue losses, or opportunity costs
  • Any issues arising from the use or inability to use the Service

6. Plan Limitations and Usage

Plan limits and features are subject to:

  • Administrative discretion and may be modified without notice
  • Fair usage policies as determined by our administrators
  • Provider-specific limitations that may change
  • Model-specific restrictions that may be imposed

7. Administrative Rights

We reserve the right to:

  • Modify, suspend, or terminate accounts without prior notice
  • Change plan features, limits, or pricing at any time
  • Implement additional rules or restrictions as deemed necessary
  • Refuse service to any user for any reason
  • Define and enforce usage policies not explicitly stated in these terms

8. User Responsibilities

You agree to:

  • Use the Service in compliance with applicable laws and regulations
  • Not abuse, misuse, or attempt to circumvent Service limitations
  • Maintain the security of your API keys and account credentials
  • Report any security vulnerabilities or issues promptly
  • Accept full responsibility for all activities under your account

9. Prohibited Activities

You may not:

  • Use the Service for illegal activities or harmful content generation
  • Attempt to reverse engineer, hack, or compromise the Service
  • Share account credentials or resell Service access
  • Generate excessive load or attempt denial-of-service attacks
  • Violate any third-party AI provider terms of service

10. Intellectual Property

The Service and its original content, features, and functionality are owned by WictzAPI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

11. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

12. Refunds and Cancellations

Given the digital nature of our service and immediate access provision:

  • All sales are generally final
  • Refunds may be considered on a case-by-case basis at our sole discretion
  • Unused plan time does not carry monetary value for refund purposes
  • Technical issues do not automatically qualify for refunds

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time without prior notice.Changes will be effective immediately upon posting. Your continued use of the Service after changes constitutes acceptance of the new terms.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Turkey, without regard to conflict of law provisions.
