2. Subject of the Agreement

This Distance Sales Agreement governs the sale and delivery of digital service plans for AI API access through the WictzAPI platform. The service provides:

  • Access to AI models and providers through unified API
  • Plan-based usage credits and quotas
  • API key management and monitoring tools
  • Usage analytics and billing information

3. Product/Service Information

3.1 Digital Service Plans

Our service offers various digital plans with different features, durations, and usage limits. Plan details including:

  • Plan duration (e.g., 30 days, 90 days)
  • Token/request quotas and limits
  • Available AI models and providers
  • Pricing in Turkish Lira (TL) or other supported currencies

3.2 Service Characteristics

Digital Nature: All services are provided digitally through our platform. No physical products are delivered.

  • Immediate access upon successful payment
  • One-time purchase model (not subscription)
  • Time stacking for multiple purchases of same plan
  • Digital delivery only

4. Pricing and Payment

4.1 Pricing

All prices are displayed in Turkish Lira (TL) or applicable local currency including all taxes. Prices may be subject to change without prior notice.

4.2 Payment Methods

Payments are processed through PayTR payment gateway, supporting:

  • Credit and debit cards
  • Bank transfers
  • Digital wallets (where available)
  • Other payment methods supported by PayTR

4.3 Payment Terms

Payment must be completed before service activation. Service access begins immediately upon successful payment verification.

5. Order Process and Confirmation

5.1 Order Placement

To purchase a plan:

  1. Select desired plan from pricing page
  2. Confirm plan details and pricing
  3. Proceed to payment through PayTR
  4. Complete payment verification
  5. Receive immediate service activation

5.2 Order Confirmation

Upon successful payment, you will receive:

  • Payment confirmation from PayTR
  • Service activation notification
  • Updated account dashboard with plan details
  • Access to purchased plan features

6. Delivery and Performance

6.1 Digital Delivery

Services are delivered digitally and immediately upon successful payment. No physical delivery is involved.

6.2 Service Activation

Plan activation occurs automatically within minutes of payment confirmation. In case of delays:

  • Contact our support system immediately
  • Provide payment confirmation details
  • Manual activation will be processed within 24 hours

7. Right of Withdrawal

7.1 Digital Content Exception

Important Notice: According to Turkish Consumer Protection Law Article 15(m), the right of withdrawal does not apply to digital content delivered immediately upon purchase.

7.2 Service Characteristics

Since our service provides immediate digital access to AI APIs and the service begins performance immediately upon payment, the standard 14-day withdrawal right does not apply.

7.3 Exceptional Circumstances

Refund requests may be considered in exceptional circumstances such as:

  • Technical failures preventing service access
  • Billing errors or duplicate charges
  • Service not delivered as described

Such requests will be evaluated on a case-by-case basis at our sole discretion.

8. Seller Obligations

We commit to:

  • Provide accurate plan and pricing information
  • Activate services promptly upon payment
  • Maintain reasonable service availability
  • Provide customer support through our platform
  • Protect customer data according to our Privacy Policy

9. Buyer Obligations

Buyers must:

  • Provide accurate account and payment information
  • Use services in compliance with Terms of Service
  • Respect usage limits and fair use policies
  • Report technical issues promptly
  • Maintain account security and API key confidentiality

10. Service Limitations and Disclaimers

10.1 Service Availability

We do not guarantee 100% service uptime or availability. Service may be affected by:

  • Planned maintenance and updates
  • Third-party AI provider limitations
  • Technical issues beyond our control
  • Force majeure events

10.2 Limitation of Liability

Our liability is limited to the amount paid for the specific plan.We are not liable for:

  • Indirect or consequential damages
  • Business losses or lost profits
  • Third-party service interruptions
  • Data loss or corruption

11. Plan Changes and Modifications

11.1 Plan Features

We reserve the right to modify plan features, limits, or availability at any time.Changes may include:

  • Available AI models and providers
  • Usage quotas and rate limits
  • Plan pricing and duration options
  • Feature availability and restrictions

11.2 Active Plan Modifications

Modifications to active plans will be communicated through:

  • Platform notifications
  • Email announcements (where applicable)
  • Dashboard updates

12. Force Majeure

Neither party shall be liable for delays or failures in performance resulting from circumstances beyond reasonable control, including but not limited to:

  • Natural disasters or pandemics
  • Government regulations or restrictions
  • Internet infrastructure failures
  • Third-party service provider outages
  • Cyberattacks or security incidents

13. Dispute Resolution

13.1 Customer Support

For any issues or disputes, customers should first contact our support system through the platform. We aim to resolve issues promptly and fairly.

13.2 Legal Framework

This agreement is governed by Turkish law, specifically:

  • Turkish Consumer Protection Law (Law No. 6502)
  • Turkish Commercial Code
  • Distance Sales Regulation
  • Electronic Commerce Law

13.3 Jurisdiction

Any legal disputes will be subject to the jurisdiction of Turkish courts and consumer arbitration committees.

14. Personal Data Protection

Customer personal data is processed in accordance with:

15. Administrative Rights and Changes
